First Amendment protection is not limited to "pure speech" -- books, newspapers, leaflets, and rallies. It also protects "symbolic speech"
 
 
When I think of the news media and how it depends so totally on the First Amendment, I at the same time think how all other forms of self expression are so totally linked to this one part of the rule of our government, but how some are not being recognized due to long and diligent labeling as amusement or otherwise by those who would seek to silence them. Just as the artist has the freedom to express himself in his art, the speaker in his speech and the author in his writings, so does the gamefowl breeder express himself in the perpetuation and creation of his fowl and their actions. Other issues may enter into the overall picture on this form of expression when in organized events, but none the less the basic action of the breeder is one of self expression and yes, even the basic act of allowing the fowl to engage in their natural instincts is moreover  the extension of the breeders self expression in the art of creation of the fowl to completion.

........Mr. President, this legislation is needed for humane reasons. But it is also urgently needed to protect poultry health and public health. In 2002 to 2003, we had an outbreak of exotic Newcastle disease among poultry in my home State of Nevada, as well as in California, Arizona, and Texas. According to the USDA, this deadly disease was spread in large part by illegal cockfighters.......

      Some laid blame for the 2003 exotic Newcastle disease outbreak in Southern California on game chickens. Even though UC Cooperative Extension poultry specialist Francine Bradley said she doesn't believe game chickens were responsible for bringing the disease into the state, officials then realized the importance of offering education on bird health to the owners of all types of California fowl.

       "Our Chula Vista point of entry (into the United States) is the busiest in the world," Bradley said. "Chickens run freely in Mexico, where Newcastle is endemic. The statistical odds suggest that regular tourists probably walked through Mexican streets and picked up the disease, then walked into their own backyards where they raise a few chickens."

       In fact, Bradley said, five ring-necked parakeets were the first birds to have the Newcastle virus isolated in them in the spring of 2002. She said game chicken producers were offended by allegations that game chicken trade with Mexico and lax care for the birds caused the costly outbreak.

........The USDA wanted to pursue Federal charges, to complement the local effort, but the U.S. Attorney's Office declined to prosecute because the Federal crime was only a misdemeanor. Increased penalties will provide a greater incentive for Federal authorities to pursue animal fighting cases.........
